This staff attorney position reports to the Legal Director and General Counsel for Triangle Physician Network, LLC (TPN), who also serves as Assistant General Counsel for UNC Health Care System (UNC HCS). In this in-house counsel role, the attorney will provide significant health care law and corporate transactional counsel for TPN, which is a large physician practice group affiliated with UNC HCS. Attorney also will be responsible for providing legal advice and legal services in support of the operations of UNC Hospitals and UNC HCS. Responsibilities Provides legal advice and counsel to clinical staff regarding medical-legal matters, including informed consent, privacy, confidentiality, credentialing, end-of-life decision-making, and standard of care. Analyzes the impact and application of federal and state health care laws and regulations, including Stark, HIPAA, the Civil Monetary Penalties Law, fraud and abuse laws, and Medicare Conditions of Participation in connection with the clinical, strategic, and business operations of TPN and UNC HCS. Provides advice regarding relationships and transactions with hospitals, physicians, vendors, managed care companies, and employers. Prepares, reviews, and negotiates contracts for complex transactions with other providers and payors, incorporating state and federal health care regulatory requirements, as necessary. Prepares, reviews, and negotiates contracts for services, real property, supplies, equipment, information services and software, and develops systems to facilitate contract initiation, renewal and revision to support ongoing needs of client. Develops and reviews policies and procedures for business and clinical functions. Advises administration and management regarding corporate, business, and operational issues, including employee relations and personnel management. The position involves direct interaction with the senior management of TPN, UNC Hospitals, UNC HCS, with officials in various branches of state and federal government, and with other hospitals, managed care companies, insurance companies, outside vendors, and providers of health care.
Degree from an accredited law school required. Must be licensed to practice law in North Carolina. Five (5) to Six (6) years of relevant experience in a hospital, health care environment or law firm. Must have excellent oral and written communication skills.
